Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to vibeos.bluservices.xyz, dl.bluservices.xyz, and your use of the VibeOS image and the VibeTool utility (together, "the Software"). The Software is published by Dykes Ventures LLC ("we," "us," "our"). By downloading, installing, or using the Software, you agree to these Terms. If you do not agree, do not download or install it.

2. Windows licensing and no affiliation with Microsoft

VibeOS is an independently produced customization of Windows 11. It is not affiliated with, endorsed by, sponsored by, or approved by Microsoft Corporation.

  • You must supply your own license. We do not sell, bundle, or provide a Microsoft Windows license, product key, or activation. Obtaining a valid license is your responsibility, and the Microsoft Software License Terms apply to your use of Windows.
  • You are responsible for activation. Activation status is between you and Microsoft. We do not activate Windows for you, and we make no representation about whether any activation method works or is permissible.
  • Trademarks. Microsoft, Windows, and Windows 11 are trademarks of Microsoft Corporation. We use these names only to describe what the Software is built on.
  • Your own compliance. Before installing, you are responsible for confirming that your intended use complies with the Microsoft Software License Terms that apply to you. If your license does not permit a modified image, do not install VibeOS.

3. Assumption of risk

VibeOS is an operating system image. Installing it overwrites the contents of the drive you install it to.

  • Back up all data before you begin. We are not responsible for data loss, and we cannot recover it for you.
  • Installing a custom operating system may void hardware warranties, violate a managed-device policy, or breach an employer's acceptable use rules. You are responsible for checking before you install.
  • Custom images can behave differently from stock Windows on specific hardware. Test on non-critical machines first.
  • Do not install VibeOS on a device you do not own or are not authorized to modify.

4. Antivirus and SmartScreen warnings

VibeTool is an unsigned or newly signed Windows executable and may trigger Microsoft Defender SmartScreen or third-party antivirus warnings. This is common for small-publisher installers and is not by itself evidence of malware. We recommend verifying the download as described in section 6 before overriding any warning. Do not disable your antivirus to run the Software, and do not use VibeOS as a reason to weaken security on a machine that holds data you care about.

5. Acceptable use

You agree not to:

  • Redistribute, resell, rebrand, or rehost the VibeOS image or VibeTool as your own product, or bundle them into a paid offering, without our written permission.
  • Use the Software in violation of any law, or to gain unauthorized access to any system or network.
  • Represent VibeOS as an official Microsoft product or use our marks in a way that suggests endorsement.
  • Use the Software to disable security controls on a device you do not own or administer.

6. Verifying your download

Published binaries are content-addressed and named with a build hash, and the current release manifest is published at dl.bluservices.xyz/version.json. Verify the hash in the filename or manifest against the file you downloaded before running it. If they do not match, do not run the file and report it to us.

7. No fees, no warranty

VibeOS and VibeTool are provided free of charge. THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, SECURE, COMPATIBLE WITH YOUR HARDWARE, OR FREE OF INTERRUPTION. Any software you install carries inherent risk, and you accept that risk.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST DATA, LOST PROFITS, LOST REVENUE, HARDWARE DAMAGE, CORRUPTED INSTALLATIONS, ACTIVATION FAILURES, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SOFTWARE, EVEN IF WE WERE ADVISED OF THE POSSIBILITY. BECAUSE THE SOFTWARE IS PROVIDED FREE OF CHARGE, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Nothing in these Terms limits liability that cannot be limited under applicable law.

You agree to indemnify and hold us harmless from claims arising out of your use of the Software in violation of these Terms or of the Microsoft Software License Terms.

9. Support and changes

Support is community-based through the VibeOS Discord and GitHub issues. There is no service level agreement, no guaranteed response time, and no commitment to fix any particular issue or to release future versions. We may modify, suspend, or discontinue the Software or any distribution channel at any time. We may update these Terms; the current version is always at this URL, and continued use after an update means you accept it.

10. Refunds

The Software is free, so there is nothing to refund. If you paid a third party for a copy of VibeOS, that is between you and them; we have no relationship with that seller and cannot refund it.

11. Governing law and disputes

These Terms are governed by the laws of the State of Louisiana, without regard to its conflict of law rules. The parties will attempt to resolve any dispute informally by written notice and 30 days of good faith discussion. If that fails, the dispute will be resolved in the state or federal courts located in Louisiana, and each party consents to venue and personal jurisdiction there.

12. General and contact

These Terms and the Privacy Policy are the entire agreement between you and us regarding the Software. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent.
